    Introduction

    Iodine Software, LLC (“Iodine”, “we”, or “us”) created this Privacy Policy to disclose how we collect, use, disclose, or store personal information and other data collected about you. 

    Additional privacy policies or notices may apply and will be provided based on the nature of the processing of the applicable data or your relationship with Iodine.

    If you use a website, application, service, or other property displaying this Privacy Policy, you consent to this policy and the collection, use and sharing of your personal information as described herein and in accordance with the applicable agreements, including any applicable terms of service or End-User License Agreement.

    Some organizations may choose to engage us as a data processor for certain services and in such case that collection, use and sharing of personal information may be governed by the agreement between Iodine and our customer as well as the customer’s privacy policy, in addition to or instead of this Privacy Policy.

    Personal Information Collected and Received

    When and how do we collect your information?

    Iodine may collect, share, use or store information when:

    • You visit or engage with an Iodine website, application or other digital property that displays this Privacy Policy.
    • The website, application or services sends us error reports or collects certain analytics data.
    • You register as an end-user of our services and an account is created for you.
    • You provide information, such as user contributed content, survey information, when you join a mailing list, or in conjunction with a trade show or event.
    • You contact us for assistance.
    • We communicate with each other.
    • We are engaged by a customer to perform services for them or on their behalf.
    • You use, review or purchase our products or services.
    • We engage with third parties.

    Some personal information may also be collected by another party, such as a customer, service provider, social media company, or other vendor. Where you interact with another party, particularly if you have an account with that third party, then they may collect additional information that is governed by that third party’s privacy notice.

    What kind of information do we collect?

    Iodine may collect the following types of information from or about you:

    • first and last name
    • email address
    • street address
    • telephone number
    • employer
    • job title
    • signature
    • username
    • password
    • gender
    • occupation
    • interests
    • information on the pages you access
    • information you may volunteer, such as survey information
    • location information, as further described in the “Global Positioning System” paragraph below

    What about sensitive information?

    Iodine does not require you to include sensitive information (e.g. racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union memberships, genetic data, biometric data, data concerning health or data concerning sexual orientation). If you provide such sensitive information as listed above without an express agreement covering it, you acknowledge that you have provided explicit consent concerning the collection, use and disclosure of such information. We will not process your sensitive personal information other than as permitted by applicable law.

    Generally, our collection of sensitive personal information is limited to information about employees or applicants in connection with their employment as well as certain standard information about customer accounts of business users in connection with the operation of our services. We do not process your sensitive personal information outside of the permissible purposes allowed by law.     Use and Disclosure of Personal Information

    How do we use your personal information?

    Iodine may use and disclose personal information that we collect or receive about you to:

    • deliver the products and services that are requested.
    • manage your customer relationship and provide you with customer support.
    • perform analysis about your use of the websites, applications and/or services.
    • communicate with you by e-mail, postal mail, telephone and/or mobile devices about products or services that may be of interest to you.
    • enforce our terms and conditions and other agreements.
    • perform services as a processor on behalf of our customer.
    • manage our business, including testing, development, and other functions as part of improving and expanding the services offered.
    • conduct a merger or sale of all or substantially all our business or assets, which includes the sale, assignment or other transfer of your personal information in connection with such transaction.
    • respond to investigation, court orders, legal process, or to investigate, prevent, or take action regarding illegal activities, suspected fraud, or situations involving potential threats to the physical safety of any person, or as otherwise required by law.
    • perform functions as otherwise described to you at the time of collection.

    Will we disclose your personal information to third parties?

    WE WILL NEVER SELL YOUR EMAIL ADDRESS, OR ANY OTHER PERSONAL INFORMATION, TO ANY THIRD PARTY WITHOUT YOUR PERMISSION. 

    Except as described in this section, we will not disclose your personal information to any third party without notifying you of our intent to share the information.

    From time to time, we may partner with companies based on the interests of our users. In such case, we will do so in a manner that respects your privacy and is consistent with the disclosures in this Privacy Policy.

    Iodine reserves the right to disclose information when required by law.

    We use other companies to perform services necessary to our operations. While providing these services, those companies may have access to your personal information.  However, except as expressly agreed in writing with an Iodine customer, we will not be liable for any damages that may result from the misuse of your personal information by these companies.

    Iodine may use your IP address to help diagnose problems with Iodine’s server and to administer Iodine’s web site. Your IP address may also be used to help identify you and your online profile and to gather broad demographic information.

    The Iodine site registration form requires users to give Iodine contact information (such as your name and email address) and other information. Iodine uses your contact information from the registration form to send you information about Iodine. Your contact information may also be used to contact you when necessary.

    We may also disclose, on an anonymous basis, statements made by our users. With your consent, we may also post your name along with your statement or testimonial.

    Protected Health Information (“PHI”)

    Iodine’s services involve information that qualifies as PHI subject to the Health Insurance Portability and Accountability Act (HIPAA). Iodine enters into business associate agreements with its customers and service providers in accordance with HIPAA. Iodine and its service providers may use and disclose protected health information in accordance with such agreements. Iodine services may involve the aggregation or de-identification of PHI, and the use or disclosure of such aggregated or de-identified information as permitted by applicable laws and customer contractual agreements.

    Other Information

    Iodine may collect, use and disclose other information from your use of the website, applications or services, provided such information does not individually identify you or otherwise qualify as personal information (or similar) under applicable law. Iodine shall have the right to aggregate and retain records of such data including, but not limited to, usage, activity logs, and click-throughs. Iodine may de-identify personal information in accordance with applicable laws and any applicable contractual agreement. Iodine may disclose data under this section, whether in the form collected or a derivative form, to third parties provided it is presented in an aggregate or deidentified form.

    Additional Privacy Rights

    If you live in a jurisdiction that provides for additional rights regarding your personal information, such as the right to access or delete your personal information, or your personal information is covered by an applicable law that provides for additional rights, please contact us using the contact information below to exercise those rights.

    California Privacy Rights

    In this section, we provide additional information to residents in certain US states, including California, about the categories of personal information we collect or about your privacy rights under applicable law such as the California Consumer Privacy Act (“CCPA”). 

    Below is a list of categories of personal data we collect and may have collected or disclosed in the past 12 months:

    Category A: Identifiers;
    Category B: Personal Data categories listed in the California Customer Records statute;
    Category C: Protected classification characteristics under California or federal law;
    Category D: Commercial information;
    Category F: Internet or other electronic network activity;
    Category G: Geolocation data; and
    Category I: Professional or employment-related information.

    Because PHI is excluded from the CCPA definition of personal information, the preceding disclosure primarily relates to our employees, prospective employees and business contacts in California. The above list does not include information about personal data collected and disclosed while operating as a service provider to our customers.

    We maintain personal information for as long as is necessary for the fulfillment of the purposes described herein, or otherwise described at the time of collection, unless otherwise restricted by an applicable law or Iodine has adopted a shorter data retention period.

    Additionally, we have not sold for valuable consideration or shared for cross-contextual behavioral advertising any consumer’s personal information in the preceding 12 months.

    If you meet the definition of a consumer under the CCPA and we have collected personal information (as defined in the CCPA and subject to its exemptions and limitations) about you, please contact us at compliance@iodinesoftware.com or send a letter to the address below to submit a request to access, correct or delete your personal information, or exercise any other rights provided by the law, such as the right to limit the use of your sensitive personal information. We will not discriminate or retaliate against, or penalize, an individual for the exercise of their rights under the CCPA.

    Because we do not sell, for valuable consideration, or share, for cross-contextual behavioral advertising, personal information of consumers subject to the CCPA, we do not offer the right to opt-out of the sale or sharing of personal information at this time.

    California Civil Code Section 1798.83 permits you to request certain information regarding our disclosure of personal data to third parties for the third parties’ direct marketing purposes. To make such a request, please contact us by sending an email to compliance@iodinesoftware.com.

    Our site, products, and services are not intended to appeal to minors.  However, if you are a California resident under the age of 18, and a registered user of our site or service, California Business and Professions Code Section 22581 permits you to request and obtain removal of content or information you have publicly posted. To make such a request, please send an email with a detailed description of the specific content or information to compliance@iodinesoftware.com. We will process your request in compliance with applicable law.

    Under California law, California residents who have an established business relationship with us may opt-out of our disclosing personal data about them to third parties for their marketing purposes.

    Children’s Privacy

    We do not knowingly collect any information from anyone who we know to be under the age of 13. If you are under the age of 18, you should use this website only with the involvement of a parent or guardian and should not submit any personal information to us. If we discover that a person under the age of 13 has provided us with any personal information, we will use commercially reasonable efforts to delete such person’s personal information from all Iodine systems.

    Global Positioning System

    Global Positioning System (GPS) tracking technology may need to be enabled in Iodine products and services in order to determine the location (latitude and longitude) of users of the Iodine products and services. We will request your permission prior to such geolocation tracking. Where authorized, this information is transmitted as necessary for the products and services, which may include transmission to Iodine, its service providers (including hosting provider), and Iodine’s users or customers. Iodine does not provide this information to any other third party.  This information is used in conjunction with Iodine’s applications. You acknowledge and consent to the use of this technology where it is enabled, unless you (a) decline access to such information in the app; or (b) contact us via the contact information below. Some elements of the services may not be accessible to you if you decline to provide geolocation data.

    Push Notifications

    Push notifications are the messages that mobile apps send to your mobile device. You may receive notifications for new messages and invites and other messages related to Iodine and/or its software and services. Other message types may be considered for push notifications in the future. You can also control which notifications you currently receive.

    We send push notifications to your mobile device through services such as Apple’s Push Notification Service for iOS devices and Google’s CD2M and Cloud Messaging for Android devices. Both services are standard features of these mobile device operating systems. However, to ensure you receive proper notifications, we will need to collect certain information about your device such as operating system and user identification information. The privacy policy of the service provider manages access, use and disclosure of your personal data that results from your use of these services. If you no longer wish to receive these types of communications, you may turn them off at the device level.

    Security

    Iodine uses industry-standard technologies when transferring and receiving consumer data exchanged between Iodine and other companies to help ensure its security. This site has security measures in place to protect the loss, misuse and alteration of the information under Iodine’s control. Iodine’s servers are backed up regularly and protected by security systems. However, there is no guarantee that your personal information in any system is completely secure.

    Cookies

    “Cookies” are small pieces of information that are stored by your browser on your computer’s hard drive. The Iodine site may use cookies for several purposes, including but not limited to, keeping track of your session, preferences or shopping cart, and for advertising or marketing purposes. Iodine may also use cookies to deliver content specific to your interests and to save your password. Iodine may use an outside ad company to display ads on the Iodine site. These ads may also contain cookies.

    We may use standard internet technology, such as web beacons and other similar technologies, to track your use on our sites and software. We also may include web beacons in promotional e-mail messages or newsletters to determine whether messages have been opened and acted upon. The information we obtain in this manner enables us to customize the services we offer our users to deliver targeted advertisements and to measure the overall effectiveness of our online advertising, content, programming or other activities.

    We may allow third parties, including our authorized service providers, advertising companies, and ad networks, to display advertisements on our site or software. Iodine and these companies may use tracking technologies, such as cookies, to collect information about users who view or interact with these advertisements and connect to the Iodine properties or software. This information allows Iodine and these companies to deliver targeted advertisements and gauge their effectiveness.

    In certain locations, you may exercise the right to opt out by following the Opt-Out process below. 

    Do Not Track Requests

    Your web browser may have a setting that allows you to automatically send a “Do Not Track” message to the websites you visit. Iodine does not currently respond to such requests, unless required by applicable law.

    Links

    Iodine may create links to other web sites. Iodine will make a reasonable effort to link only to sites that meet similar standards for maintaining each individual’s right to privacy. However, many other sites that are not associated or authorized by Iodine may have links leading to our site. Iodine cannot control these links and Iodine is not responsible for any content appearing on these sites.

    International Transfer of your Personal Information

    Except where expressly agreed in writing otherwise, the website, application and services are hosted and operated in the United States and subject to United States law. Any personal information that we collect from you may be stored and processed in the United States. If you are accessing the website, application or services outside of the U.S., you consent to the processing and transfer of your personal information to the United States. Please be advised that United States law may not offer the same privacy protections as the law in your jurisdiction.

    Updates

    Iodine may update or revise this policy at any time. We may also send you other information about our data collection, use and sharing practices. When we make a material change to this Privacy Policy, we will take suitable measures to notify you in a manner that is consistent with the significance of the changes made or as required by applicable law. Please review this Privacy Policy regularly to be informed of how Iodine collects and protects your personal information.

    Opt-Out
